Depuis plusieurs années, le principe de précaution prend de l’ampleur et voit ses contours se modeler et se définir, aussi bien à l’échelle internationale qu’européenne ou française. Malgré tout, il n’a pas la même importance, en fonction de l’échelle à laquelle on se place, et tend à être confondu avec le principe de prévention, deux notions pourtant totalement distinctes. Plus que jamais les questions de climat, de biodiversité, de justice sociale, de gestion des deniers publics ou encore de valorisation et (...) de gestion des ressources sont au cœur des problématiques gérées par les territoires et notamment, par les communes, premier échelon territorial de décision. Le principe de précaution qui inonde l’ensemble de ces matières voit ses contours réduits en France, notamment par une jurisprudence autocentrée, préférant faire la part belle aux questions franco-française d’organisation territoriale, plutôt que d’appliquer un principe qui devient universel, favorisant ainsi l’inertie de l’État central plutôt que l’action locale. Une situation qui ne saurait perdurer davantage. (shrink)

Lorsque la controverse sur les gaz de schiste a éclaté au Québec, les pouvoirs publics ont fait le pari de miser sur la science et les nouvelles connaissances pour refroidir le débat et construire l’acceptabilité sociale de la filière. Or, si la stratégie retenue a permis de documenter la technique de fracturation sous ses multiples aspects et d’approfondir les connaissances sur le milieu physique, biologique, économique et social ainsi que sur l’encadrement juridique, les recherches scientifiques sur la filière des gaz (...) de schiste n’ont pas calmé le jeu, tant s’en faut. Le dispositif mis en place pour piloter les études, le Comité sur l’évaluation environnementale stratégique sur les gaz de schiste, a très tôt suscité une vive opposition en raison de sa composition et de son mandat ; parallèlement, une science de contestation s’est développée à travers la mise sur pied d’un réseau de scientifiques opposés à la filière. Si bien que loin de pacifier les débats, la démarche scientifique a participé de la controverse jusqu’à la fin du processus marqué par la publication du second rapport du Bureau d’audiences publiques sur l’environnement. Le présent article propose de retracer les rapports entre science et acceptabilité sociale dans le dossier des gaz de schiste au Québec à l’échelle de la filière elle-même, mais aussi du processus décisionnel mis en place par le gouvernement pour fixer sa politique en la matière. Depuis plusieurs années, il est acquis que les avocats ont joué un rôle important, voire décisif, dans la création et le développement du droit de l’environnement. Ils ont ainsi été à l’origine des grands procès emblématiques qui ont abouti à la création de principes fondamentaux du droit de l’environnement qui sont aujourd’hui : le droit à un environnement sain, le principe de prévention, le principe de précaution, le principe pollueur payeur. Cela n’a été possible que grâce à la décision des (...) juges, d’abord des juges de première instance et plus tardivement les juges supérieurs, ce qui suppose l’existence d’États de droit, et en tout cas d’États qui pratiquent la séparation des pouvoirs. Sans l’indépendance du juge, pas de nouvelles jurisprudences possibles à l’écoute de la demande sociale, liée d’abord à une exigence des conditions relatives à la qualité de la vie et, aujourd’hui, compte tenu des nouvelles menaces liées au climat et à l’effondrement de la biodiversité, à la protection de la vie même. Passant ainsi d’une demande locale à une demande globale, la question environnementale concerne désormais toute la planète. De ce fait, le droit de l’environnement doit progresser constamment et se transformer depuis sa création dans les années 1970 sous la même et encore plus forte impulsion de ces auxiliaires de justice. Cet article présente la Base de Données (BDD) développée dans le cadre du projet ERC Mapping Ancient Polytheisms (MAP), qui vise à étudier les systèmes religieux des mondes grecs et ouest-sémitiques dans la longue durée (ca. 1000 av. – 400 ap. J.-C.) à travers le prisme des « attributs onomastiques divins ». On entend par là les noms, épithètes, formes verbales, et autres appellations que les Anciens attribuaient à leurs dieux. La construction d’un tel outil, qui n’est pas sans précédents (...) mais qui s’efforce de franchir un seuil quantitatif et qualitatif, répond à un double impératif : permettre le traitement exhaustif des myriades de dénominations divines en prenant en compte la diversité de contextes dans lesquels elles apparaissent ; utiliser ces dénominations comme les révélateurs des configurations divines et de l’agentivité humaine. La complexité inhérente aux séquences onomastiques divines nécessite l’élaboration d’une base de données soigneusement structurée, souple et précise à la fois. Ainsi, à la suite d’une mise au point terminologique et historiographique, on présente ici la structure de la BDD MAP, et notamment le dispositif d’analyse des formules qui permet la modélisation des séquences onomastiques divines. Background: Low rates of participation of adolescents and young adults (AYAs) in clinical oncology trials may contribute to poorer outcomes. Factors that influence the decision of AYAs to participate in health research and whether these factors are different from those that affect the participation of parents of children with cancer. Methods: This is a secondary analysis of data from validated questionnaires provided to adolescents (>12 years old) diagnosed with cancer and parents of children with cancer at 3 sites in Canada (...) (Halifax, Vancouver, and Montreal) and 2 in the United States (Atlanta, GA, and Memphis, TN). Respondents reported their own research participation and cited factors that would influence their own decision to participate in, or to provide parental authorization for their child to participate in health research. Results: Completed questionnaire rates for AYAs and parents were 86 (46.5%) of 185 and 409 (65.2%) of 627, respectively. AYAs (n = 86 [67%]) and parents (n = 409 [85%]) cited that they would participate in research because it would help others. AYAs perceived pressure by their family and friends (16%) and their physician (19%). Having too much to think about at the time of accrual was an impediment to both groups (36% AYAs and 47% parents). The main deterrent for AYAs was that research would take up too much time (45%). Nonwhite parents (7 of 56 [12.5%]) were more apt to decline than white parents (12 of 32 [3.7%]; P < .01). Conclusions: AYAs identified time commitment and having too much to think about as significant impediments to research participation. Addressing these barriers by minimizing time requirements and further supporting decision-making may improve informed consent and impact on enrollment in trials. (shrink)

PURPOSE: There is an increasing demand for researchers to provide research results to participants. Our aim was to define an appropriate process for this, based on needs and attitudes of participants. METHODS: A multicenter survey in five sites in the United States and Canada was offered to parents of children with cancer and adolescents with cancer. Respondents indicated their preferred mode of communication of research results with respect to implications; timing, provider, and content of the results; reasons for and against (...) providing results; and barriers to providing results. RESULTS: Four hundred nine parents (including 19 of deceased children) and 86 adolescents responded. Most parents (n = 385; 94.2%) felt that they had a strong right to research results. For positive results, most wanted a letter or e-mail summary (n = 238; 58.2%) or a phone call followed by a letter (n = 100; 24.4%). If the results were negative, phone call (n = 136; 33.3%) or personal visits (n = 150; 36.7%) were preferred. Parents wanted the summary to include long-term sequelae and suggestions for participants (n = 341; 83.4%), effect on future treatments (n = 341; 83.4%), and subsequent research steps (n = 284; 69.5%). Understanding the researcher was a main concern about receiving results (n = 145; 35.5%). Parents felt that results provide information to support quality of life (n = 315; 77%) and raise public awareness of research (n = 282; 68.9%). Adolescents identified similar preferences. CONCLUSION: Parents of children with cancer and adolescents with cancer feel strongly that they have a right to be offered research results and have specific preferences of how and what information should be communicated. Differences in empathic abilities between acting, dance, and psychology students were explored, in addition to the appropriateness of existing empathy measures in the context of these cohorts. Students (N= 176) across Higher Education Institutions in the United Kingdom and Europe were included in the online survey analysis, consisting of the Reading the Mind in the Eyes (RME) test, the Interpersonal Reactivity Index (IRI), the Empathy Quotient (EQ), and the E-drawing test (EDT), each measuring particular facets of empathy. Based on existing (...) evidence and our understanding of the discipline practices, we predicted that acting students would perform the best at identifying people’s emotional expressions but might lack other cognitive or affective empathy skills, particularly those related to emotional reactions. This cohort thus provides an opportunity to evaluate different empathy measures. While actors showed significantly higher RME scores than dancers, the difference between actors and psychologists was marginal. Moreover, actors’ scores did not differ significantly on other empathy measures, such as their concern for others’ emotional wellbeing or fantasy, both measured by IRI subscales. Psychology students scored highest in the IRI perspective taking subscale and the data supported anecdotal evidence that psychologists were more concerned for others’ emotional wellbeing than dancers or actors. Dancers seemed the least concerned with others’ perspectives and emotional states, which we explained through a somatosensory ‘inward’ focus required by their art form. Nevertheless, compared to the general population, our groups reported higher empathic abilities on all IRI subscales except for personal distress. Altogether, our study shows that the RME, the IRI, and the EDT vary in their susceptibility to different facets of empathic abilities in acting, dance, and psychology students whereas the EQ does not. Emotions can be expressed and perceived through language, facial expressions, or behavior. As many empathy tests focus on one type of signal they might miss other strategies. Where empathy tests are applied to individuals that have a predominance to read or respond to others in a particular way, as we showed through these three disciplines, they might not capture these empathic strategies. We thus propose that empathy tests must evolve by means of integrating varied forms of communication. (shrink)

Pericytes, like vascular smooth muscle cells, are perivascular cells closely associated with blood vessels throughout the body. Pericytes are necessary for vascular development and homeostasis, with particularly critical roles in the brain, where they are involved in regulating cerebral blood flow and establishing the blood-brain barrier. A role for pericytes during neurovascular disease pathogenesis is less clear—while some studies associate decreased pericyte coverage with select neurovascular diseases, others suggest increased pericyte infiltration in response to hypoxia or traumatic brain injury. Here, (...) we used an endothelial loss-of-function Recombination signal binding protein for immunoglobulin kappa J region (Rbpj)/Notch mediated mouse model of brain arteriovenous malformation (AVM) to investigate effects on pericytes during neurovascular disease pathogenesis. We tested the hypothesis that pericyte expansion, via morphological changes, and Platelet-derived growth factor B/Platelet-derived growth factor receptor β (Pdgf-B/Pdgfrβ)-dependent endothelial cell-pericyte communication are affected, during the pathogenesis of Rbpj mediated brain AVM in mice. Our data show that pericyte coverage of vascular endothelium expanded pathologically, to maintain coverage of vascular abnormalities in brain and retina, following endothelial deletion of Rbpj. In Rbpj-mutant brain, pericyte expansion was likely attributed to cytoplasmic process extension and not to increased pericyte proliferation. Despite expanding overall area of vessel coverage, pericytes from Rbpj-mutant brains showed decreased expression of Pdgfrβ, Neural (N)-cadherin, and cluster of differentiation (CD)146, as compared to controls, which likely affected Pdgf-B/Pdgfrβ-dependent communication and appositional associations between endothelial cells and pericytes in Rbpj-mutant brain microvessels. By contrast, and perhaps by compensatory mechanism, endothelial cells showed increased expression of N-cadherin. Our data identify cellular and molecular effects on brain pericytes, following endothelial deletion of Rbpj, and suggest pericytes as potential therapeutic targets for Rbpj/Notch related brain AVM. This paper addresses the existence of Hopf bifurcations in a directed acyclic network of neurons, each of them being modeled by a Hindmarsh–Rose neuronal model. The bifurcation parameter is the small parameter corresponding to the ratio of time scales between the fast and the slow dynamics. We first prove that, under certain hypotheses, the single uncoupled neuron can undergo a Hopf bifurcation. Hopf bifurcation occurrences in a directed acyclic network of HR neurons are then discussed. Courts and jurors sometimes refuse to assign liability to defendants on the basis of statistics alone, despite their apparent reliability. I argue that this refusal is best understood as a recognition of defendants’ right to security. Understood as a robust good in Philip Pettit’s sense, security requires that someone risking harm to others’ protected interests adopt a disposition of concern that controls against wrongfully harming them. Since trials risk harm, the state must adopt such a disposition. Statistics leave open the (...) possibility of innocence and so wrongful harm in a way that the state cannot ignore; if it does use such statistics, it makes defendants wrongfully insecure. This explanation of the problem of bare statistical evidence is especially apt because security grounds the right to a fair trial and judicial procedural rights more generally. (shrink)

Cet article étudie l’hypothèse selon laquelle l’Hymne homérique à Déméter aurait été composé par une femme comme un divertissement présenté au cours des Thesmophories d’Éleusis. L’argumen­tation repose sur le thème fondamentalement féminin de l’Hymne, de même que sur les positions en présence, sur la question de l’audience adéquate et du contexte de la récitation pour de tels soucis féminins. Ces préoccupations s’avèrent identiques à celles des poétesses lyriques comme Sappho, Corinne, Nossis et Érinna. La composition par une femme pour (...) un auditoire féminin explique le traitement humiliant infligé à Zeus dans l’Hymne. D’autres particularités y trouvent aussi leur explication : par exemple, les traits inhabituels de la diction de l’Hymne, ou la question de savoir pourquoi il n’existe aucune référence à cette version du mythe avant la période post-classique. En dépit de leur caractère hypothétique, ces arguments devraient nous permettre d’abandonner la prétendue évidence de l’auteur masculin d’une composition aussi féminine. (shrink)

Constituent power is an idea with a long tradition in modern political thought but has been largely abandoned since the middle of the twentieth century. Here I offer a new account of constituent power that avoids problems of the classical account, including the paradox of constitutionalism, and clarifies how individuals contribute to creating their shared political order. I argue that constituent power should be understood as an individual power-with: the agential power to constitute a legal order with others. Our individual, (...) banal acts of law-abidingness each partially effect the collective outcome. We generally exercise constituent power unconsciously and automatically, guiding our actions to succeed as defined by law and relying on the legal system to take up our contributions and effectively combine them with others. Avicenna holds that since God has existed from all eternity and is immutable and impassible, he cannot come to have an attribute or feature that he has not had from all eternity. He also claims for the simultaneous causation. A puzzle arises when we consider God’s creating this world. If God is immutable and impassible, then his attributes associated with his creating this world are unchanging. So, God must have been creating the world from all eternity. But then God’s creative (...) act, one might object, seems to be no different from a matter of natural necessity. This is a threat to divine freedom, for God would then have no choice concerning his creative action. Anthony Ruffus and Jon McGinnis argue that this puzzle can be solved in such a way that Avicenna can consistently affirm divine freedom along with divine simplicity. They suggest that Naṣīr al-Dīn Ṭūsī’s interpretation might help to show that it is false that Avicenna’s God cannot choose absolutely. For it is still open to him to choose either to create eternally or to refrain from creating anything at all. Ruffus and McGinnis argue that since creating or not creating anything at all do not correspond to two distinct concepts, Avicenna’s account of divine simplicity, which denies any multiplicity in divine mind, is safeguarded along with divine freedom. I claim that God’s omnirationality requiring that he always acts for reasons is a serious threat to such an interpretation. (shrink)

This book, the first of its kind, puts forward a novel, unified cognitive account of skeptical doubt. Historically, most philosophers have tried to tackle this difficult topic by directly arguing that skeptical doubt is false. But N. Ángel Pinillos does something different. He begins by trying to uncover the hidden mental rule which, for better or worse, motivates our skeptical inclinations. He then gives an account of the broader cognitive purpose of having and applying this rule. Based on these ideas, (...) he shows how we can give a new response to the traditional problem of global skepticism. He also argues that philosophical skepticism is not just something that comes up during philosophical reflection, as David Hume, Charles Sanders Peirce and other philosophers have urged. Instead, it is of great practical significance. The rule which produces skepticism may itself be operative in certain pathologies such as obsessive-compulsive disorder, in creative endeavors, and in conspiratorial thinking. The rule can also explain some of our reluctance to trust statistical evidence, especially in legal settings. More broadly, this volume aims to breathe new life into a classic problem in philosophy by tackling it from a new perspective and exploring new areas of application. The book will be of interest to philosophers, psychologists and anyone interested in the human capacity to doubt and to question our beliefs. (shrink)

Purpose. With the consideration of anthropological tendencies in modern science, the purpose of the article is to analyze the problem of the subject of cognition, philosophical-psychological rationale for the need to complement it by the concept of "the researcher’s personality". Theoretical basis. The authors rely on post-non-classical methodological tools and basic principles of complexity theory, as well as theoretical provisions of epistemological constructivism, the results of theoretical and empirical psychological studies. In them, authors revealed psychological features of the potential of (...) self-realization of a person prone to innovation and research activities and transfessionalism, including the resources and reserves of the researcher’s personality. Originality. The concept of the subject of cognition is expanded by the concept of "researcher’s personality" and derivative concepts that describe the dynamics of self-harmonization of originative co-generative strengths and opportunities of self-realization of an enlightened person, reveal the degree of correlation in the cognition of the subjective and objective dimensions of his life. It is substantiated that further analysis of the problem of anthropologization of science requires appropriate onto-epistemological grounds that reveals the unity of cognition-education-skill as an essential characteristic of the maturity of the researcher’s personality of scientific knowledge. Conclusions. In the context of anthropological shifts in modern science, the philosophical-psychological analysis of the problem of the subject of cognition is actualized. The psychological research proves the advisability of using the "researcher’s personality" concept as a basic one for understanding the formation of an enlightened human-creator, capable of auto-eco-organization, self-transcendence, and syzygy with the Universe at different levels of innovational research activity. The self-realization of the researcher-personality is a way-search for the authenticity of the multiform unity of life, the personal meaning of scientific truth, and the self-harmonization of the originative co-generative co-determinative strengths in the knowledge of an enlightened person. Including the concept of the subject of cognition in the ontology of the unity of difference-multidimensional poly-essential autopoetic integrity, the anthropologization of science is intended to revive the ancient idea in the unity of truth, education and skill of a scientist, defining the ideal of a modern human-transfessional.
